Terms and Conditions

1. Booking and Scheduling

1. Booking Requests: All booking requests must be submitted through our website, by phone, or in person. A booking is considered confirmed only upon our written confirmation and receipt of any required deposit.
2. Session Duration: Session durations are as described in our service packages. Additional time may be available at an hourly rate, subject to photographer availability.
3. Rescheduling: You may reschedule a session with at least 72 hours' notice without incurring a rescheduling fee. Rescheduling with less than 72 hours' notice may be subject to a fee equal to 25% of the session fee.
4. Late Arrival: If you arrive late for your session, the session will still end at the originally scheduled time. No refunds or extensions will be granted for late arrivals.

2. Cancellation Policy

1. Client Cancellation: If you cancel a session with more than 7 days' notice, you will receive a full refund of any deposit paid. Cancellations made with less than 7 days' notice will result in forfeiture of the deposit.
2. Starlight Studios Cancellation: In the unlikely event that we need to cancel a session due to photographer illness, equipment failure, or other unforeseen circumstances, we will provide you with a full refund of any payments made or offer to reschedule the session at a mutually convenient time.

3. Payment Terms

1. Deposit: A non-refundable deposit is required to secure your booking. The amount of the deposit will be specified at the time of booking.
2. Final Payment: The remaining balance is due on or before the date of the photography session. We accept payments by credit card, debit card, cash, or check.
3. Late Payment: Late payments may be subject to a late fee of 1.5% per month on the outstanding balance.
4. Pricing: Prices for our services are subject to change without notice. However, once a booking is confirmed, the price agreed upon at the time of booking will be honored.

4. Copyright Ownership

1. Copyright: Starlight Studios retains all copyrights to the photographs taken during your session.
2. Usage Rights: Upon full payment, you will receive a limited license to use the digital images for personal use, including printing, sharing on social media, and creating photo albums. You may not use the images for commercial purposes without our prior written consent.
3. Commercial Use: If you require commercial usage rights, please contact us to discuss licensing options and fees.
4. Image Alteration: You may not alter, modify, or manipulate the images in any way without our express written permission.

5. Model Release

By engaging our services, you grant Starlight Studios the right to use images from your session for promotional purposes, including but not limited to our website, social media, and marketing materials. If you do not wish to grant this right, please notify us in writing prior to your session.

6. Liability Limitations

1. Personal Injury: Starlight Studios is not liable for any personal injuries or property damage that may occur during your session, unless caused by our gross negligence.
2. Loss of Images: While we take precautions to ensure the safety of your images, we are not liable for any loss of images due to equipment failure, data corruption, or other unforeseen circumstances. In such cases, we will offer a complimentary reshoot or a refund of any payments made.
3. Third-Party Services: We are not responsible for the actions or omissions of any third-party service providers, such as makeup artists or venue operators.

7. Image Delivery and Archiving

1. Delivery Time: Digital images will typically be delivered within 2-4 weeks of your session. Prints and albums may take longer, depending on the complexity of the order.
2. Delivery Method: Digital images will be delivered via an online gallery or file transfer service. Prints and albums will be shipped to the address provided at the time of booking.
3. Archiving: We archive digital images for a period of one year. After this time, we cannot guarantee the availability of your images.

8. Governing Law

These Terms and Conditions shall be governed by and construed in accordance with the laws of the State of Illinois, without regard to its conflict of law provisions.

9. Changes to Terms

We reserve the right to modify or update these Terms and Conditions at any time without prior notice. Your continued use of our services after any such changes constitutes your acceptance of the new Terms.
